Attorney Miller posted that recent verdict research "found that the median (midpoint of data, not average) jury award for personal injury trials in Pennsylvania is $40,974. Personal injury plaintiffs in Pennsylvania receive damages in 48% of tort cases that go to trial.)
I am surprised how low the median (the mean, or average, may be higher)was. I am also surprised by how many verdicts were for the the Plaintiff. I would love to know what year(s) this information was based upon. It would be very interesting to see how these numbers have fluctuated over time. Obviously, because of inflation, I would expect to see a steady increase in the mean/median damage awards. It would, however, be much more interesting to see how the percentage of verdicts in favor of the Plaintiff have fluctuated over the years. My feeling is that we are swinging back toward an era of more Plaintiff friendly thinking. Share this post :
