PA Law Requires Bouncers Be Licensed

Pennsylvania enacted the Private Detective Act in 1953.  While it sounds like it would only cover private eyes the Act also specifically covers anything to do with the business of "watch, guard, or patrol agency."  This means that bars and clubs in Pittsburgh and across Pennsylvania that employ security guards and bouncers are required to comply with the Private Detective Act.

Section 13 of the Act states that no person or business shall, among other things, engage in the business of watch, guard or patrol, for the purpose of providing guards (bouncers and security) to protect other persons (patrons) without first obtaining a license to do so per the terms of the Act.  So that means that any bar or club in Pittsburgh, Pennsylvania that employs security guards is required to have a state issued license for the security personnel.  If they do not, then they are in direct violation of the Private Detective Act.  Given that the majority of bars and clubs in Pittsburgh skimp on even purchasing liability insurance its safe to assume that many of them are not complying with this act.

The Act goes on to note that any person or business intending to incorporate a security detail within their establishment shall, for each and every establishment and sub-establishment, file an application for licensure i.e. you have to get the license from the state before you start having security watch over your club.  Then there are a ton of things the business must provide the state in order to obtain the license.  Oddly, I do not see much language in the Act requiring such businesses to pass a security test or undergo training...which you would think would be the whole purpose of the act...to make sure people have well-qualified security protecting patrons.

The Act also requires the business to prominently display their certificate of license inside each given establishment.  The Act also has strong language for the duty owed by the business owner.  Specifically, the Act states the business licensee "shall at all times during such employment be legally responsible for the good conduct in the business of each and every person so employed and shall be responsible for the reasonable supervision of said employees' conduct."   Additionally, any business licensed under the Act who knowingly employs a person who has been convicted of a felony shall be guilty of a misdemeanor and, upon conviction thereof, shall be sentenced to pay a fine of not more than $5,000 or undergo imprisonment for not nore than one (1) year, or both.

In Pennsylvania, compliance with the Private Detective Act can be a key issue in handling a civil negligent security case.  If the establishment was in violation of the Act at the time of the incident you have a black letter law to show to a jury. Share this post :

  1. I would like to know why cops can become one but the average person who has a family to feed can not this is crazy. This is why I will not waste my money on driving to these bootleg election.

  2. Is there a way to get a licence so you can run a bouncer co. Meanning the bar or club calls your co. And you pervide them with your licenced bouncers?

  4. I need help please.! Im new in the town "Reading Pa" and I need to be a certificate bouncer cause were I used to live I didn't need it , the law in PA is totally different that others state. So basically what I need is to know where I have to go here in reading?
